Leading triathlete recommends firm’s personal injury service
Allan McDougall Solicitors’ Alex Robertson, an associate in our personal injury team, recently acted for triathlon champion Shona Bathgate, who had been injured in a road traffic accident. Her bike was also written off.
Shona commented: “As a cyclist a collision with a car is a traumatic event; as a competing triathlete it brings another level of worry. A member of triathlon club TriWorks Edinburgh when I was unfortunately knocked off my bike, I contacted one of the squad sponsors, Allan McDougall Solicitors, to deal with my claim.
Alex Robertson from the firm was in contact with me shortly after the accident. At this early stage Alex gave me practical advice about preserving evidence and recording symptoms of my physical injuries. She took the details of the driver’s insurance and intimated the claim immediately. Alex understood my concern about getting back on the road when the time was right. She sent the damage report from the bike shop to the insurers and secured a very quick interim payment so that I was able to replace my bike without delay.
Alex is an experienced personal injury litigator and she talked me through what to expect in dealing with the claim for my physical injuries, including recovery of physio costs and payment for the help that my husband and children had to give me as I recovered. She also discussed not acting too quickly, but waiting until the effects of the injuries had settled. When the time was right, Alex arranged a thorough medical examination with an expert in emergency medicine. She was also in contact with my physio to get all up to date treatment information. Alex negotiated skilfully with the insurance company and emphasised my position as a competing triathlete. Interestingly the insurance company had looked at my Strava account and represented that I must have been fully recovered, but Alex pointed out to them that the cycling recorded was about half of the year before!
Alex kept me informed, even if it was just to say that the insurance company was not responding. When offers came in, she gave the benefit of her experience and was not afraid to commence litigation to achieve an increased offer. In the end I was happy with what was offered and to complete the claim without the need to proceed to litigation.
